Terms and Conditions of Sale
Dear Customer,
We inform you that the general conditions of sale listed below indicate, in compliance with current consumer protection regulations, the terms and methods for making online purchases on the LA MAGGIOLINA website — hereinafter referred to as the Seller — of the products you are interested in, in a safe, simple, and convenient manner. We therefore invite you to read and accept them in order to proceed with the purchase.
I. PURPOSE
These general conditions of sale govern the sale of products marketed by the Seller to consumer users and users acting for purposes related to business activities.
These general conditions become effective as of the date of their acceptance by the customer on the website, which constitutes acceptance for all legal purposes pursuant to Art. 1341 of the Italian Civil Code.
The company reserves the right to modify these general conditions of sale at any time by publishing them on the website.
Any contractual or non-contractual liability of the company for direct or indirect damages to persons and/or property resulting from the partial or total non-acceptance of an order is excluded.
II. PURCHASE PROCEDURES
Product purchases are made by accessing the website and completing the registration process during the purchase phase. A description containing the main characteristics of each product is available on the website. All information provided to assist in the purchase is to be considered generic informational material.
Please note that the image accompanying the product description may not perfectly represent its features and may differ in color, size, or accessories shown.
The correct receipt of the order is confirmed by the Seller via an automatic email sent to the address provided by the customer during registration. This confirmation will include an “order number,” to be used for any communication with the company. The message will include all data entered by the customer, who agrees to verify its accuracy and promptly communicate any corrections.
In the event of non-acceptance of the order, the Seller guarantees prompt notification to the customer.
III. PAYMENT METHODS
All prices listed on the website are intended as retail prices and therefore include VAT.
Prices may change without notice, and the only valid price is the one indicated at the time the order is confirmed.
For certain products subject to promotional pricing, the Seller reserves the right to accept orders by reducing the quantity, after notifying and obtaining acceptance from the customer; otherwise, the order will be considered canceled.

If the order is canceled — either by the customer or due to non-acceptance by the Seller — the order and the commitment of the corresponding amount will be canceled (release times depend solely on the banking system). Once the transaction has been canceled, the Seller cannot be held responsible for any damages arising from the release of the amount by the banking system.
The Seller reserves the right to request additional documentation from the customer proving credit card ownership. If such documentation is not provided, the Seller reserves the right not to accept the order.
Transaction security is ensured by a data encryption system (SSL) and by direct, protected, and certified connections.
IV. DELIVERY METHODS
For invoicing purposes, the information provided by the customer at the time of the order shall be used. The customer may request a copy of the invoice or tax receipt within three months of issuance.
Any delivery charges are borne by the customer and are indicated during the order process.
The Seller cannot be held responsible for delays in order processing or delivery.

APPLICABLE LAW
The sales contract between the customer and the Seller is considered concluded in Italy and governed by Italian law. Unless otherwise provided, Italian law applies.
For the resolution of civil and criminal disputes arising from this distance sales contract, if the customer is a consumer — meaning a natural person purchasing goods for purposes unrelated to professional activities, and therefore does not provide a VAT number — territorial jurisdiction lies with the court of the consumer’s municipality of residence. In all other cases, jurisdiction is exclusively that of the court where the Seller is based.
INFORMATION ON PERSONAL DATA PROCESSING
SUBJECT: Information notice and request for consent pursuant to Articles 13, 23, and 26 of Legislative Decree 196/2003 regarding the protection of personal data.
The Seller informs you, pursuant to Art. 13 of Legislative Decree 196/2003, that:
– The aforementioned decree imposes several obligations on those who process personal data (collection, recording, processing, storage, communication, dissemination, etc.) belonging to others, requiring data subjects to be informed about their rights and the characteristics of the data processing;
– The processing of your personal data, which will be requested from you and communicated by you, will be carried out at the Seller’s premises in compliance with principles of necessity and relevance, using manual and electronic procedures, for legal and fiscal obligations and for the execution of contractual obligations;
– The data controller is the Seller. The data processor is located at the company’s registered office. During processing activities, the controller and authorized personnel may become aware of the data, which will be processed in compliance with privacy laws and principles of fairness;
– Processing will be carried out using manual and automated systems capable of storing, managing, and transmitting the data, strictly in accordance with the purposes of the processing, based on the information in our possession and with your commitment to promptly communicate any corrections, additions, and/or updates;
– Excluding communications or disclosures required by law or contract, the data provided will be used solely to fulfill legal obligations;
– The provision of data is strictly necessary in relation to the above-mentioned processing purposes. Failure to provide the required data will make it impossible to correctly fulfill contractual and legal obligations, thereby compromising continuation of the relationship between the parties;
– You may exercise your rights at any time pursuant to Art. 7 of Legislative Decree 196/2003, including:
• knowing whether data concerning you exists and receiving it in intelligible form;
• being informed about the controller, the purposes and methods of processing, any data processors, and the subjects to whom the data may be communicated;
• obtaining updates, rectification, or integration of data;
• requesting deletion, anonymization, or blocking of unlawfully processed data;
• objecting, for legitimate reasons, to data processing within the limits of the law;
• objecting to the sending of advertising materials, market research, or commercial communications.

Right of Withdrawal
Online customers acting as consumers are entitled to the right of withdrawal as provided by Articles 64–67 of Legislative Decree 206/2005 (Consumer Code).
This right is reserved exclusively for natural persons acting for purposes unrelated to their profession. No right of withdrawal is granted to legal entities or natural persons acting in a professional capacity.
Pursuant to Art. 64 of the Consumer Code, the consumer has 14 calendar days from receipt of the purchased products to exercise the right of withdrawal, meaning they may return the products received and obtain a refund of the price paid, without penalties and without the need to specify the reason.
This right applies to all products purchased online on this website, except for sealed audiovisual or software products that have been opened by the customer.
Return shipping costs are borne by the consumer.
The right of withdrawal is void if the returned product is not intact — for example, if essential elements are missing (accessories, cables, manuals, etc.) or if the product has been damaged for reasons other than transport from the Seller to the consumer and not previously reported.
Without limiting the right of withdrawal, upon delivery the consumer who suspects transport damage must refuse the shipment or accept it with explicit reservation.
Procedure for Exercising the Right of Withdrawal
To exercise the right of withdrawal, the consumer must send, within 14 calendar days from receipt of the product, a communication clearly stating the intention to withdraw from the purchase contract.

Order Cancellation Request
An order may be canceled in full if, at the time of the cancellation request, the shipment is still being prepared and in any case if the payment has not yet been collected; in such cases, no cost will be charged to the customer.
If, at the time of the cancellation request, the product has already been handed over to the courier or the payment has been collected, the consumer must exercise the right of withdrawal and return the goods to the Seller.
